WARESIX PRIVACY POLICY

The following Privacy Policy describes how Waresix collects, uses, processes, distributes, discloses and protects your personal information that you provide to Waresix through Waresix’s Websites and Apps.

Please read this Privacy Policy thoroughly to ensure that you understand how Waresix processes and manages your data. Unless otherwise defined, all capitalized terms used in this Privacy Policy have the same meanings as those in the Terms of Use applicable between you and Waresix.

A. Definition

1. “Application or App” means a software that Waresix develops whether patented or not, which has rights to designs, inventions and/or other intellectual property including but not limited to copyright, trade secrets, trademarks, service marks and other intellectual property rights owned by Waresix, including but not limited to Trucking Management System (TMS) and Warehouse Management System (WMS), Transporter App (TA) and Driver App (DA) as may be amended from time to time.
2. “Personal Information” means information about you that Waresix personally captures through the Website and/or App including but not limited to your name, address, date of birth, occupation, telephone number, bank account, e-mail address or any other information that can identify a specific individual or company that has or is using Waresix’s Website or App .
3. “Services” means logistics services using a fleet offered by the Partner through the Website and/or App which may include transportation services, warehouse rental, and/or other services related to logistics services.
4. “Partner” means a third-party partner of Waresix including but not limited to agents, vendors, suppliers, contractors, sub-contractors and other parties who provide Services to Waresix, perform tasks and/or represent Waresix in connection with the provision of Services through Waresix’s Website or App .
5. “Customer” means a person or business entity who visits or accesses the Waresix Website or App for the purpose of obtaining information or using the logistics Services provided by the Partner and Waresix.
6. “Website” means the Waresix Website with the domain waresix.com.

B. Information Collection

1. Waresix collects your Personal and/or company Information that you provide through Waresix’s Website or App when:
   Registration.
   You register, where you will be asked to provide your e-mail address, name, phone number, account password, and/or other information; and
   Use of the App/Website. You use the Waresix App/Website to find a Service, you will be asked to provide information in the form of location, both your starting point and destination point, information related to the goods, the total price of the goods and/or other information.
   The information you provide above will be automatically collected by Waresix. The provisions regarding the information to be provided above are subject to change at any time in accordance with the internal policies of Waresix.
2. The information you provide through Waresix’s Application or Website will only be distributed and intended to fulfill the purpose of cooperation between Waresix and Partners in order to provide the best Service for you.
3. When you visit Waresix’s Website, Waresix administrators process your technical data including your Internet Protocol Address (IP), internet browsing history, the internet browser you are using and the duration of each visit. This allows Waresix to ensure that the Website functions properly and to improve those functions to provide a more user-friendly browsing experience.
4. Registering for a Partner Account. If you register as a Partner through the Website or App, Waresix will collect, compile, verify, store and distribute data internally and to Customers, such information includes vehicle specifications such as police number, type, brand, type, color, model, body dimensions and vehicle capacity or other additional information that Waresix requires for the smooth cooperation of Service delivery.
5. Registering for a Customer Account. When you register as a Customer, Waresix will ask for your phone number and address to help you connect with Waresix Partners, this is to facilitate the ordering process you make when you use the Services available on the Website or Application.

C. Use of Information

1. Anonymous Information. Waresix uses Personal Information in an anonymous form. Waresix will use such information to monitor the most frequently used features and analyze the usage patterns of Waresix Services, such information will also be utilized by Waresix to facilitate or verify before Partner provides the Services or before Waresix approves your registration application in Waresix Services.
2. Information by Name. Waresix uses your email address, name, phone number, and account password to verify ownership of an account, as well as to communicate and inform you in connection with orders, the Website and the App periodically.
   The periodic updating of information aims to ensure the smooth status of goods delivery, resolve technical obstacles, as well as Waresix’s continuous efforts to improve the quality of the App or Website and services to you.
3. When you register your business entity on the Waresix Website or App , you will automatically agree to the terms of subscription to the Waresix newsletter. By registering, you agree that Waresix is allowed to use your Personal Information to send information in the form of Service updates on the Website or App, send special offers or promotions to you. In this regard, you are authorized to unsubscribe from the Waresix newsletter at any time.
4. When you utilize features on the Waresix Website or App, Waresix is authorized to manage your technical data, including but not limited to IP address, device identity, Global Positioning System (GPS) location, manufacturer information, model, shipment status report, trip status, and operating system of your device. Waresix will also be authorized to access and manage other technical data such as road letters, photos of Vehicle Registration Number (STNK), photos of loading and unloading locations, as well as Driver’s License (SIM) and driver’s photos.
5. Waresix uses information such as the items you submit to determine whether the Website and App can accept your order under the Terms of Use.
6. Waresix uses your information to manage and facilitate the orders and payment transactions you place and communicate directly with you to send you information in connection with the use of the App .

D. Provision of Information

1. When a Customer places an order for a Service available on the Waresix Website or App. Waresix will provide customer information such as name, phone number, location, destination and item to be delivered. Such information is used by Waresix and Partners as a basis for making service charges for the Services you order. This information is required by Partners to locate, fulfill orders and/or contact you.
2. Waresix will not provide your Personal Information to any third-party without your prior consent, with the following Exceptions: provision of Personal Information to Waresix’s business partners; to the extent that disclosure is ordered by a court, other competent authority and/or applicable laws and regulations including but not limited to responding to regulatory inquiries, facilitating investigations and/or complying with filing and reporting requirements required by applicable laws and regulations in the Republic of Indonesia; and
   in the event of a merger, sale of company assets, consolidation, restructuring, financing or acquisition of either part or all of Waresix’s business, whether carried out by Waresix against another company or otherwise in line with the business objectives of Waresix Services.
3. You hereby agree to authorize Waresix to provide Your Personal Information to the Partner as part of the terms of service to be fulfilled. Your Personal Information (i) will be automatically deleted from the Partner’s device; (ii) Waresix will inform the Partner of the prohibition of duplication of Your Personal Information; and/or (iii) Waresix will inform the Partner to delete Your Personal Information from the Partner’s device after the Service has been provided. However, Waresix does not guarantee that the Partner does not store or duplicate Your Personal Information to his/her devices or other media through any method. Therefore, You agree to release Waresix from any and all claims and/or losses that may arise from the misuse of Personal Information by the Partner in this manner.
4. Your Personal Information may be transferred, stored, used and processed in a jurisdiction other than Indonesia by parties working for Waresix in other countries. Waresix will comply with all applicable laws and regulations and use all best efforts to ensure that Waresix’s affiliates in other countries and all third-party Partners provide a level of protection equivalent to Waresix’s commitments in these Privacy Terms. Therefore, you understand and consent to the transfer of your Personal Information outside of Indonesia.
5. Waresix will also provide your Personal Information to the Partner in connection with the fulfillment of the purpose of Waresix’s cooperation with the Partner which includes allowing the Partner to introduce or offer the Services to you and/or conduct other activities including but not limited to marketing, research, analysis and development of the Services.
6. You hereby agree to authorize Waresix to provide Your Personal Information to be accessed, preserved, transferred, stored, used and processed to develop our Service.
7. We will share personal information outside of Waresix if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to:

• Meet any applicable law, regulation, legal process, or enforceable governmental request;
• Enforce applicable Terms of Service, including investigation of potential violation;
• Detect, prevent, or otherwise address fraud, security, or technical issues;
• Protect against harm to the rights, property or safety of Waresix, our users, or the public as required or permitted by law.

E. Withholding of Information

Waresix will retain and store your Information for a period of time in accordance with Waresix’s internal policies until you delete your account on Waresix’s Websites and App

F. Security

1. Your Information will only be retained for as long as necessary to fulfill the purposes for which it was collected or as long as such retention is permitted by applicable laws and regulations. Your Information will be deleted as soon as it is deemed that the purpose for which it was collected is no longer necessary in connection with the fulfillment of business or legal purposes.
2. Waresix does not guarantee security and does not guarantee that the data you provide will not be retained/interrupted while being transmitted through Waresix’s database. Any transmission of information by you to Waresix is at your own risk. You must not disclose your password to anyone. Waresix and you recognize that no matter how effective a technology is, no security system is impenetrable.
3. If you have concerns about Waresix’s handling or treatment of your Personal Information or if you believe that your privacy has been violated, you may contact Waresix explaining your identity and the nature of your complaint. Waresix will investigate your complaint and endeavor to provide a response to such complaint within a reasonable period of time after receiving the complaint submitted by you.

G. Changes to Privacy Policy

This Privacy Policy is subject to change at any time either due to changes in business activities, internal policies or due to compliance with applicable laws and regulations. In the event of any changes to this Privacy Policy, Waresix encourages you to review this page periodically for the latest information on the terms of this Privacy Policy and any changes.

In the event of any changes to this Privacy Policy, your continued use of the Waresix Website, App, and Service after the enactment of such changes shall be deemed as your consent to any changes to the Privacy Policy enacted by Waresix.

H. Miscellaneous

This Privacy Policy shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any and all disputes arising from this Privacy Policy shall be subject to the exclusive jurisdiction of the South Jakarta District Court.

I. Acknowledgment and Consent

1. By using Waresix’s Website and/or App, you acknowledge that you have read and understood this Privacy Policy and the Terms of Use and agree to Waresix’s use, practices, processing, disclosure and transfer of your Personal Information as set forth in this Privacy Policy.
2. Where the information you provide to Waresix relates to the information of another individual or third-party, you represent and warrant that you have obtained the consent of such individual and on behalf of such individual consents to Waresix collecting, using, disclosing and/or managing such individual’s Personal Information.
3. You also declare that you are the owner or legal assignee of all information that you have provided to Waresix and agree to grant Waresix the right to collect, manage, use and/or provide such information to Partners in accordance with the provisions of this Privacy Policy.

J. Stop Receiving Email

Waresix enforces the policy that you can freely decide to join or not to join the Waresix newsletter. If you wish to stop receiving emails from Waresix, please click on the unsubscribe link included in the respective e-mail or e-mails sent to you.
